I filed an action in New Jersey against three defendants for malicious prosecution. The basis of my cause of action are false and misleading statements made to law enforcement that resulted in my arrest and prosecution. I successfully defended myself against the false accusations and filed a civil suit for malicious prosecution and other causes of action, which were dismissed for Statute of Limitations issues.
Two of the defendants hired counsel and I managed to fend off attempts to dismiss for about a year. It was obvious that the Court was biased against me and was biding its time, waiting for my adversaries to file something that she could sink her teeth into and dismiss. That happened in March against one defendant and in June against another. The reasons that the Court cited are blatantly wrong. It is a matter of semantics and rulings based on fact or the ignoring of fact that stick out like a sore thumb. I have talked to attorneys and they agree that the elements for malicious prosecution exist and my case should not have been dismissed but they want to be paid exorbitant fees and I just don't have it.
I have protected my case as best I can by moving for reconsideration of the dismissals. Since the Judge delivered the decisions at 100 or more words per minute, I must first obtain transcripts to discern the precise reasons for dismissal. I had filed motions in this regard as well.
I am at a point where a trial is imminent but the motions for reconsideration and free transcripts were never dealt with, so I won an adjournment until 8/27/07. I was granted indigent status and as far as I can tell, the pending motions should result in further adjournment since the issue of free transcripts must first be decided before I can draft a motion for reconsideration. I need some guidance in these matters. I am more knowledgable than the average pro se litigant and with the right coach, I could see this case through to the end.
I am absolutely justified in my causes of action and the Court's rulings are blatantly wrong. I am looking for a lawyer/coach to help me fight off the dismissals and perhaps join with me when this matter comes up for trial. It is my expectation that if I manage to have the two dismissed defendants restored, once a trial is imminent they will look to talk settlement. The monies I am seeking to recover are $100K in defense costs, plus a lot more. The prospect of collecting is fair but depending upon what the defendants bring to the table, there may be a more lucrative law suit to follow.
